1] The present Civil Application is filed to condone the delay of 52 days in filing the Second Appeal. 2] The learned counsel for the applicant submits that due to non-communication between the applicant and his Advocate appearing before the First Appellate Court, delay has occurred in filing the Second Appeal. The learned counsel for the applicant further submits that the delay caused in filing the Second Appeal is not intentional and deliberate act. Therefore, the present Civil Application may be allowed.
