Present application has been styled as, "Application for Cancellation of Bail", however, it is to be noted that the offence that was alleged to have been committed by the respondent Nos.1 to 3 is under Section 323, 336, 506 read with Section 34 of the Indian Penal Code, 1860 and under Section 3(1)(r), (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. In view of specific provision under Section 14-A of the Atrocities Act, an appeal would lie against any order. Here, the applicant intends to challenge the order of granting bail to the respondent Nos.1 to 3 by Special Judge (Under Prevention of S.C. and S.T.

ACB_139_2021 Act), Majalgaon dated 12.05.2021 in Criminal Bail Application No.111/2021. The learned Advocate for the applicant prays for withdrawal of the application with liberty to file appeal. He is allowed to withdraw the application and if the law permits in respect of limitation, he is granted liberty to file appeal.
