Mr Natu, learned Counsel appearing on behalf of respondent no.2 - complainant in Criminal Misc. Application No.264 of 1995, pending on the file of learned Chief Judicial Magistrate, Jalgaon, submits that complainant Ashok Pundlik Kolhe has expired.

There is no prayer for substitution from the legal representatives or any person to be replaced as complainant to the complaint. 3.

In view of above, entire proceedings, pending on the file of Judicial Magistrate First Class, Jalgaon, vide Criminal Misc. Application No.264 of 1995, shall stand dismissed as abated.

As a consequence of dismissal of the complaint as abated, the present writ petition is also rendered infructuous and stands disposed of as such.
