Shobha Chandu Khamkar v. The State Of Maharashtra And Others
- 1 -
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.7428 OF 2019 Shobha w/o Chandu Khamkar Petitioner
Versus
The State of Maharashtra & others Respondents Mr.D.A.Bide, Advocate for the petitioner.
Mr.S.P.Tiwari, AGP for Respondent No.1.
Mr.S.T.Shelke, Advocate for Respondents No.2 & 3. Mr.N.V.Gaware, Advocate for Respondent No.4.
CORAM : Ravindra V.Ghuge, J.
DATE : 10/07/2019 PER COURT :
The petitioner has challenged the order dated 07.06.2019, passed by the Election Officer, Gram Panchayat Isalak, Post Nimblak, Tq. & District Ahmednagar, by which the objection raised by the petitioner to the nomination paper of Respondent No.4, has been rejected.
Notwithstanding the strenuous submissions of the learned Advocate for the petitioner, I find that several disputed questions have been raised in this petition. The elections are already concluded and the results have been declared on 24th June, 2019.
- 2 - The learned Advocate for the petitioner submits that the limitation period is fifteen days for filing an election petition. It is obvious that the petitioner had approached this Court on 13.06.2019. In view of the above, this petition is disposed off. In the event, the petitioner files an election petition within fifteen days from today, the time spent by the petitioner in this Court, in this petition from 13.06.2019 till today, shall be excused and the election petition will be considered by the competent authority on its own merits.
