The learned AGP accepts notice for respondent no.1. Mr.Pulkundwar, the learned counsel accepts notice for respondent no.2 and submits that the petitioner has alternate remedy before the Commissioner.
2] In light of that Writ Petition is disposed of with liberty to the petitioner to file appeal before the Commissioner. All contentions of the parties are kept open. The forum where the appeal would be filed shall consider the time spent in prosecuting the petition. In case if appeal is filed, the Commissioner shall endeavour to decide the appeal expeditiously preferably within 3 months from the date of filing of the appeal.
