PER COURT :- Learned counsel for the petitioner, on instructions, submits that during pendency of this writ petition, the Special Darkhast bearing No.76 of 2002 is disposed off on 16.1.2012. It appears that vide order dated 20.6.2009 the learned 2nd Jt. Civil Judge S.D., Jalgaon was pleased to issue warrant of arrest of the petitioner in terms of the provisions of order 21 Rule 38 of the Civil Procedure Code. By way of this writ petition, the petitioner/original J.D. has challenged the said order of issuance of warrant. However, the Special Darkhast No.76 of 2002 is now disposed off, this writ petition has become infructuous and the same is accordingly disposed off. Rule discharged. ( V.K. JADHAV, J. ) ...
