ORDER :

Heard learned Counsel for the petitioner, who takes exception to the order dated 08.06.2021 passed by the Collector, Nanded and the judgment dated 13.07.2021 passed by the Divisional Commissioner, Aurangabad holding the petitioner disqualified under Section 10-1 (A) of the Maharashtra Village Panchayat Act on the ground, that the Caste Validity Certificate, was not submitted within the statutory period as required by the said provision within a period of 12 months from being elected. It is an admitted position that the petitioner, was elected on 26.02.2018 (Exh-C page 24) and the period of one year expired on 27.02.2019. the Validity Certificate has been issued to the petitioner on 30.04.2021, in view of which, the non-compliance with the above statutory provision is apparent on the face of record. There is no provision for extension of time or for any other consideration. That
