The prayer in this application is for issuance of a direction to Respondent No.3 to provide all the original certificates and other relevant documents of the applicant, which are submitted by him at the time of admission to M.B.B.S. Course in the year 2015, which the applicant needs for counselling process for admission to Medical P. G..
{2} ca1026622.odt The learned Counsel for the applicant has pointed out certain orders of this Court, including the order dated 08.07.2021 in Civil Application No. 5639 of 2021 in Writ Petition No. 6440 of 2021 and the order dated 28.10.2021 in Writ Petition No. 12100 of 2021, in order to submit that in similar circumstances and challenge, this Court had directed releasing of the documents subject to furnishing an undertaking by the petitioner. Upon hearing learned Counsel for the parties, the application is disposed of by directing the petitioner to give an undertaking to the College as well as before the Registrar (J) of this Court that in the event petition is decided against the petitioner, the petitioner would pay the fees as demanded by the Respondents.
Upon submission of such undertaking, the Respondents may not withhold original documents of the petitioner on the ground of non payment of fees. The petitioner shall file such undertaking before the College along with a copy of the undertaking furnished before the Registrar (J) of this Court.
