This is an application for condonation of delay of 1764 days caused in filing the first appeal.

Perused the application and heard learned A.G.P. for the applicant-State. None present for the respondents. Learned A.G.P. for the applicant-State pointed out the grounds stated in the application that the proposal for filing appeal was sent. Thereafter, there was official communication for preferring the appeal. He further pointed out that the delay is not caused deliberately and due to administrative difficulty the delay is caused. Therefore, the appeal was not preferred within limitation.

In view of the above and considering the reasons stated in

ca9341.14 -2the application, it would be proper to condone the delay caused in filing the appeal, as the delay is not deliberate. The application, therefore, is allowed in the interest of justice. The delay is condoned. 4.

In first appeal, issue notice to the respondents, returnable on 04.12.2025.
