The Petitioner's claim of belonging to the 'Koli Mahadev' Scheduled Tribe Category is pending validation before the Competent Scrutiny Committee. An Affidavit undertaking dated 30/06/2024, is tendered across the bar, praying that the service of the Petitioner be protected, until her claim is decided and the Petitioner would not seek increment/pay fixation/promotion/service benefits, etc. until her claim is validated. Same is marked as 'X' for identification. The learned Advocate for the Petitioner submits on instructions that the

6463.24wp (2) Petitioner is willing to extend this affidavit undertaking even to the extent of the rejection of the claim by the Scrutiny Committee and the affidavit would be binding until the Court validates the claim of the Petitioner.

The learned A.G.P. submits on instructions that the claim of the Petitioner which is pending since 12/04/2023, would be decided by 31/03/2025.

In view of the above, this Writ Petition is disposed off. The Petitioner would be bound by the affidavit until her claim is validated, either by the Competent Scrutiny Committee or by any Court. In view of the said affidavit undertaking and the above directions, we direct Respondent No.3/General Manager, Vidarbha Kokan Gramin Bank, Nagpur, not to terminate the service of the Petitioner, solely for the reason that her claim is pending.
