Heard rival submissions. The applicants being the legal heirs of appellant No. 1 -Manjulabai Mahadeo Hake are seeking permission to bring themselves on record by condoning the delay of 33 days. It appears that applicant No.1 is already on record as applicant No.2. 2.

As such, the application is allowed in terms of prayer clause B and C only to the extent of applicant No.1B.

Though the middle name of deceased Manjulabai is shown as Mahadu in death certificate, but the learned counsel for the applicants submits that Mahadeo and Mahadu are one and the same person.
