Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks bail in Crime No.111 of 2024, registered with Ambajogai Rural Police Station, District Beed, for the offence punishable under Section 302 read with Section 34 of the IPC.

The deceased and the applicant were friends. It has been alleged against the applicant that he called the deceased near bridge. The assailant came there lateron and assaulted the deceased with knife. The prosecution has further case that investigation is going on about the role played by the applicant.

Perused the papers placed on record. It seems that the main assailant came on the spot after reaching the deceased and the applicant there. The assailant assaulted the deceased with knife. The applicant has been doubted only for the reason that he was the silent spectator. However, there are no allegations of conspiracy or enmity with the deceased. Only being a silent spectator, it is difficult to link the applicant with the incident at this juncture. Nothing is to be recovered from him. The material investigation has been completed. Therefore, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant PARMESHWAR HARIBHAU SOLANKE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing of the charge sheet. (S. G. MEHARE, J.) ...
