Heard learned counsel appearing for the petitioner and learned APP appearing for the respondent/State.

Learned APP appearing for the respondent/State on instructions submits that even prior to filing this petition supplementary statement of the informant has been recorded.

Learned counsel appearing for the petitioner

( 2 ) disputed the statement made by the APP that supplementary statement of petitioner has been recorded. Learned counsel for the petitioner submits that, though the petitioner has filed the application on 23.04.2017 to the Superintendent of Police, Jalgaon, the said authority has not taken cognizance of the said application and has not taken any decision.

In that view of the matter we direct the Superintendent of Police, Jalgaon to consider the application of the petitioner as expeditiously as possible, however on or before 04.08.2017 and communicate the said decision to the petitioner.

Needless to observe that if the application of the petitioner is favourably considered by the Superintendent of Police, Jalgaon, in that case he shall issue necessary directions to the Investigating Officer. 6.

With above observations this criminal writ

( 3 ) petition stands disposed of.

7.

List the matter on 09.08.2017 so as to ascertain compliance of the order passed today.
