IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 31 WRIT PETITION NO.7063 OF 2022 LALCHAND PRABHAKAR PATIL

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...

Advocate for Petitioner : Mr. Patil Jitendra Vijay AGP for the respondent - State : Mr. P.G. Borade Standing Counsel for the respondent no. 2 : Mr. A.B. Kadethankar ...

CORAM

: MANGESH S. PATIL, J.

DATE : 11 JULY 2022 PC :

Heard the learned advocate for the petitioner. 2.

The petitioner is questioning the formation of Gat for holding elections of Zilla Parishad under the Maharashtra Zilla Parishand and Panchayat Samiti Act, 1961 and the Maharashtra Zilla Parishad (Electoral Divisions and Conduct of Elections) Rules, 1962 and in the process is challenging the report submitted by the Divisional Commissioner to the State Election Commission touching the aspect of formation of electoral divisions.

3.

Going by the nature of petition, the main relief being claimed as also the interim relief, the petition, in my considered view, is squarely covered by the observations of the Division Bench made in writ petition no. 6765 of 2022 (Anant S/o Baburao Golait (Gahilot)

2 WP / 7063 / 2022 Vs. The State Election Commission of Maharashtra and others) and connected matters decided on 05-07-2022. Since the relief being claimed is not in aid for holding the imminent elections, but rather intended to create an obstacle, it would not be appropriate for this Court to cause any interference.

4.

Writ petition is dismissed.
