Apprehending arrest in crime no. 0102 of 2025 registered at Neknoor Police Station, District Beed for offence under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act and Sections 143(2) and 143(3) of BNS.

Learned counsel submitted that, applicant is owner of the premises and he has entered into an agreement. Said premises was raided by police authorities wherein some act of human trafficking was alleged to be conducted. That, present applicant has no direct
-2concern with the alleged acts. That, said premises was not in direct control of the applicant. Considering the nature of allegations, nothing is to be recovered and as applicant is ready to co-operate, learned counsel urges for grant of bail.

Learned counsel has placed on record order in similar matter i.e. Bail Application No. 1102 of 2025 wherein this Court had granted bail.

Learned APP has strongly opposed on the ground that applicant has indulged in above act of human trafficking. During raid, girls, who were used, were found with customers. For similar crime, applicant was previously found to be involved and moreover, he invited attention to the statement of one of the victims and stated that, present applicant was getting flesh trade done. 5.
After considering the above submissions and on going through the papers, it seems that the Police Officer, on receipt of secret information, carried out raid at Janki restaurant and lodge where flesh trade was said to be conducted. After sending dummy customer and on receipt of signal, raid was conducted, where ladies were found to be entertaining customers. Manager Bobade was taken in custody.
-3According to informant, the Hotel is owned by present applicant and it was to his knowledge that such business was conducted. Copy of leave and licence between present applicant and one Mohammad Ibrahim is placed on record. Considering the same, when applicant was not present in the premises at the time of raid, and he being named for merely being owner, and when no further recovery or discovery is shown to be made at his instance, further investigation can be carried out by securing his presence. Hence, following order :
ORDER
I.
The application is allowed.
II.
In the event of arrest of the applicant in connection with 0102 of 2025 registered at Neknoor Police Station, District Beed for offence under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act and Sections 143(2) and 143(3) of BNS, he shall be released on executing P.B. and S.B. of Rs.15,000/- with one surety in the like amount.
III.
The applicant shall attend the concerned Police Station as and when called by the Investigating Officer till filing of the charge sheet and co-operate in the investigation.
