Present application has been filed by the original claimants seeking enhancement in the compensation that was awarded by the tribunal. The applicants intend to challenge the said award, but there is delay of 15 days in filing first appeal.

Taking into consideration the fact that applicant No.1 is widow and applicant Nos.2 and 3 are minors, so also applicant Nos.4 and 5 appears to be the parents of the deceased and the fact that the delay is of only 15 days and the sole earning member of the family had expired, under such circumstance, liberal approach is taken and even without issuing notice, the delay is hereby condoned.

Civil Application stands allowed and disposed of accordingly.
