PER COURT :

1) Learned Counsel appearing for respondent/employee, on instructions, informs that in pursuance to the decision recorded by the Labour Court, the respondent/employee was reinstated in service and retired on attaining the age of superannuation on 31st May, 2009. The employee has also been paid terminal benefits accrued to him. In this view of the matter, we are of the considered view that no fruitful purpose would be served in entertaining the appeal. Apart from this, the findings recorded by the Labour Court on appreciation of evidence, which have been confirmed by learned Single Judge, do not call for any interference. The Letters Patent Appeal is devoid of substance and same stands dismissed. Pending Civil Application, if any, stands disposed of.
