Heard the learned counsel for the applicant and the learned APP for the respondent / State.

The facts of the case have been discussed in detail in the order dated 12.07.2022. Learned counsel for the applicant would submit that the false allegations have been made against the applicant. Two inconsistent reports have been lodged by the deceased. The report is not genuine. Considering the allegations, the custodial interrogation of the applicant is not essential.

Learned APP would submit that two inconsistent reports have been filed by the deceased, but the allegations are not serious. Hence, the application may be rejected.

Perused the papers. There appears substance in the argument advanced by the learned counsel for the applicant. There are two inconsistent reports. Even after considering the allegations, this Court is of the view that this is not a fit case for custodial interrogation. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) The interim protection granted to the applicant ROSHANI W/O. MOHAN RATHOD @ ROSHANI NANDU CHAVHAN by an order dated 12.07.2022 stands confirmed on the same terms and conditions.
