The learned counsel for the petitioner submits that, validation proceedings in respect of tribe claim of the petitioner as belonging to Thakur (S.T.) are pending with the Committee. However, the respondent No. 2 has issued notice to the petitioner calling upon the petitioner to submit the validity certificate within one month from the receipt of notice. According to the learned counsel, it is not in the hands of the petitioner to decide the validation proceedings within stipulated period. 2.

Mr. Patil, the learned counsel for the respondent No. 1

2 wp 6401.14 accepts that the validation proceedings in respect of tribe claim of the petitioner are pending with the respondent No. 1. 3.

The respondent Nos. 2 and 3, though served are absent. 4.

Considering the above aspects of the matter, we pass the following order.

The respondent Nos. 2 and 3 shall not take any adverse action against the petitioner only on the ground that the validation proceedings in respect of tribe claim of the petitioner are pending. The respondent No. 1 shall endevour to decide the validation proceedings in respect of tribe claim of the petitioner expeditiously and preferably within a period of one (01) year from today. The petitioner shall co-operative in expeditious disposal of the proceedings before the respondent No. 1. Of course, the respondent Nos. 2 and 3 are entitled to take action against the petitioner according to the judgment of the respondent No. 1 in validation proceedings. The writ petition is accordingly disposed of. No costs.
