In the year 2021 petitioner came to be elected as a Member of Village Panchayat Sarsam (BK), Tq. Himayat Nagar, District Nanded. Her election was from reserved post for women belonging to Scheduled Tribe category. Alongwith her nomination, she had filed token indicating that her claim for caste validity certificate is pending before the ST Certificate Scrutiny Committee. Sicne 23.12.2020.

In view of the provisions of section 10-1A of the Maharashtra Village Panchayats Act, petitioner was required to file validity certificate within a period of one year or the extended period under various notifications. It appears that petitioner could not comply the aforesaid requirement till

wp 7306.25.odt 9.7.2024. In the result, petitioner has been declared as disqualified.

Learned advocate appearing for petitioner relying upon the Maharashtra Ordinance No.III of 2025 dated 30.4.2025 submits that time limit to submit caste validity certificate has been further extended and petitioner is entitled for benefit of such extension. However, clause no.3 of the Ordinance shows that extension of period has been specifically made applicable for the elections that took place on 1.8.2022 and thereafter till the date of issuance of the ordinance. 4.

Apparently, election of the petitioner was on 18.1.2021 i.e. much prior to the cutoff date. 5.

In that view of the matte, there is no error in the impugned order. Hence, writ petition stands rejected. ( S. G. CHAPALGAONKAR, J. ) ...
