This Miscellaneous Civil Application has been moved by applicant-wife seeking transfer of proceedings initiated by respondent-husband for restitution of conjugal rights bearing Hindu Marriage Petition No.14 of 2014 in the court of Civil Judge, Senior Division, Biloli to Family Court at Nanded. 2.

It is contended on behalf of the applicant that the respondent is required to attend to proceedings by the applicant under the Domestic Violence Act in the Family Court at Nanded

{2} mca127-16 and he has been so attending the proceedings. 3.

In spite of service, the respondent has not caused appearance. This, to a large extent, exhibits tacit consent to the request made in the Miscellaneous Civil Application. 4.

In view of the same, the Miscellaneous Civil Application stands allowed in terms of prayer clause "B" and stands disposed of.
