Heard both the sides.

By order dated 08.09.2020, in Civil Application No.5222 of 2020 in First Appeal No.3233 of 2019 and other connected matters, though the respondent / acquiring body has deposited 50 % of the amount awarded by the reference court, the applicants / original claimants therein from the same award are permitted to withdraw 50 % amount out of the amount deposited before this Court.

The learned counsel appearing for the respondent / acquiring body has also not disputed the same. 4.

In view of the above, on the same terms and conditions, the applicants herein also permitted to withdraw the amount. Hence, the following order :

ORDER

(i) Civil Application is hereby partly allowed.

(ii) The applicants / claimants are hereby permitted to withdraw the amount to the extent of 50 % of the amount along with the accured interest, if any, out of the amount deposited before this Court on furnishing an undertaking to the satisfaction of the Registrar (Judicial) of this Court.
