Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.71 of 2023 registered with Daithna Police Station, District-Parbhani for the offence punishable under Sections 498-A, 304-B, 306, 323, 504, 506 read with Section 34 of the Indian Penal Code.

The incident happened in the canal near the place where the deceased and applicant were residing for labour work. The marriage of the deceased was performed on 23rd December 2020. The material witness states that quarrel took place between deceased and applicant when he asked the deceased to pay money, which she had received from her father to purchase the articles. However, while lodging the report, allegations of demand of dowry have been levelled.

The papers show that soon after the quarrel in fit of anger the deceased went to the canal and jumped into the same. Then she found dead. Considering the material on record, whether the allegations of demand of dowry were correct, would be tested before the trial Court. No weapon has been used in the crime. Therefore, it would be inappropriate to keep the applicant behind the bars. Hence the following order:-

O R D E R

i) Bail Application stands allowed.

ii) The applicant - Siddheshwar S/o Chandrakant Muddhe be

released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in the above crime, on the condition that:- (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the trial on each and every effective date.
