It is not in dispute that proceedings initiated by the applicant-wife for restitution of conjugal rights under Section 9 of the Hindu Marriage Act are being conducted in the Court of Civil Judge Senior Division, Amalner, wherein the respondent-husband has already put his appearance. 2.
The applicant-wife is custodian of four years old son born out of the relationship, which fact is not in dispute.

The respondent consents for transfer of proceedings to the Court of Civil Judge Senior Division, Amalner, to be heard with aforesaid
mca107.17 (2) proceedings for restitution of conjugal rights and both the parties submit that they shall co-operate with the Court of Civil Judge Senior Division, Amalner, in expeditious disposal of both the proceedings, viz. the proceedings of which transfer is sought and the proceedings for restitution of conjugal rights.

In view of above, Misc. Civil Application stands allowed in terms of prayer clause (A). It is directed that the transferred proceedings initiated under Section 13 of the Hindu Marriage Act be tagged and heard with proceedings for restitution of conjugal rights initiated by the applicant, which are pending on the file of Civil Judge Senior Division, Amalner. 5.
Upon an assurance by both the parties that they shall co-operate with the Civil Judge Senior Division, Amalner in expeditious disposal of the proceedings, in my opinion, it will be appropriate to observe that the Trial Court may make an endeavour to decide both proceedings within six months from today.

Both the parties agree that they shall appear before the Court of Civil Judge Senior Division, Amalner on 12th October, 2017. (NITIN W. SAMBRE, J.) amj
