After hearing the learned Advocate for the appellant, the learned APP states that the pregnant victim has been deserted by her parents and is in a Rehabilitation Centre. The victim was practically seven months' pregnant when the FIR was registered on 06.09.2020. The DNA test of the probable baby would throw further light on this case. Charge-sheet is yet to be filed.

The learned Advocate for the appellant seeks liberty to withdraw the appeal by making a statement that he would co-operate if a DNA test is to be performed, if not already performed and after the DNA test, he may consider filing of a fresh application for bail. 3.

As such, this appeal is dismissed as withdrawn with liberty as is prayed for, after the DNA test result or the filing of the charge-sheet, whichever is later.
