Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant seeks bail in Crime No.66 of 2024, registered with Manatha Police Station, Tq. Hadgaon, District Nanded, for the offences punishable under Sections 302, 498A, 323, 504, 506 read with Section 34 of the IPC. 3.

The applicant is the maternal uncle of the husband of the deceased. It has been alleged against the accused that they were ill-treated the deceased for Rs.50,000/- demanded for constructing the house. The chastity of the deceased was also suspected. The marriage was around 9 years old. The poison was administered to the deceased and she died. The strangulation mark was also found on the neck of the

978-BA.1043-24.odt deceased. The allegations against the applicants were that he was instigating the co-accused for ill-treatment and demand of dowry.

He is not residing with the deceased and other coaccused. He is a distant relative residing far away from the house of deceased. Considering the allegations levelled against him, nothing appears to be recovered from him. He is 69 years old man. For the above reasons, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SHIVAJI RAGHOJI KHANDODE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) He shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called on written notice by the Investigating Officer till filing the charge sheet.
