The appellant -State has deposited the entire amount of impugned award and the applicant -claimant is seeking withdrawal of the same. The learned AGP however strongly opposed such withdrawal and submits that the Reference Court has granted 30 times compensation of the rate awarded by the learned S.L.A.O. However, he conceded for withdrawal of 25 % of the deposited amount at this juncture. 3.

In view of the above, the applicant is permitted to withdraw 25 % of the deposited amount of compensation on usual undertaking to the satisfaction of Registrar (Judicial) of this Court. The remaining amount

be invested in F.D.R. in any Nationalized bank during the pendency of this Appeal subject to renewal on yearly basis. 4.

The application is accordingly disposed of.
