The petitioner is awaiting decision of the Education Officer on a proposal forwarded by the management for grant of approval to his transfer effected under Rule 41 and 41A of the Maharashtra Employees of Private Schools (Condition of Service) Rules, 1981.

The learned AGP waives service for all the respondents except the management. In the facts of this case, the management is not a contesting respondent.

The Writ Petition is disposed of directing the Education Officer (Secondary), to decide the proposal of the petitioner pending for grant of approval, on its own merits, as expeditiously as possible and in any case within six weeks, however, without referring to the Government resolution dated 29.04.2024 and the circular dated 03.10.2024.
