Although this petition is coming up for consideration for the first time, since an alternative remedy of filing appeal before the Chief Executive Officer, Zilla Parishad is available as per Government Resolution dated 02.02.2023, we are not inclined to entertain the present petition. Respondent Nos.1 and 3 are represented by the learned AGP while Mr. Pulkundwar learned counsel appears for respondent No.2. Respondent No.4 is the candidate selected for the post of Anganwadi Madatnis. It is the case of the Petitioner that respondent No.4 ought not to have been appointed on the said post. Since we do not intend to entertain the present writ petition, issuance of notice to respondent No.4 is dispensed with.

The learned counsel appearing for respondent No.2, on instructions further informs that, the Petitioner has already preferred an appeal

2 924.WP.8209.25.odt before the Chief Executive Officer, Zilla Parishad in terms of the relevant clause of Government Resolution dated 02.02.2023.

In that view of the matter, the Writ Petition is dismissed. However, the Petitioner is at liberty to pursue the appeal filed before the appellate authority. The appeal shall be decided, as expeditiously as possible and preferably within six weeks from today.
