This is an application under Section 439 of the Code of Criminal Procedure. The applicants have been arrested in connection with Crime No.121/2022, registered at State Excise Department, Nadurbar for the offence punishable under Sections 65(A) (E), 80, 81, 83, 90, 98(2), 103, 108 of the Maharashtra Prohibition Act, 1949. The applicants are driver and cleaner of the vehicle. They were found transporting Goa-Made Whisky worth Rs.1,03,68,000/-. Both of them have been arrested on 30/6/2022. It is informed that, the applicants do not have criminal antecedents. To facilitate further investigation, they can be directed to appear

before the investigating officer on every alternate day for a period of one month. I am, therefore, inclined to grant bail to the applicants. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicants be released on bail in connection with Crime No.121/2022, registered at State Excise Department, Nadurbar for the offence punishable under Sections 65(A) (E), 80, 81, 83, 90, 98(2), 103, 108 of the Maharashtra Prohibition Act, 1949 on their executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) each with one surety in the like amount.

(iii) The applicants shall not tamper with the prosecution evidence.

(iv) The applicants shall mark their appearance before the investigating officer on every alternate day soon after their release on bail between, 7.00 p.m. and 8.00 p.m. till next one month.
