Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in Crime No. 308 of 2022 registered with Police Station Basmath (City) District Hingoli for the offences punishable under Sections 307, 326, 323, 504 read with Section 34 of the Indian Penal Code. The first informant has two versions about the spot of the incident and weapons allegedly used by the applicant. That may be the grounds to consider the bail. However, the alleged weapons have been recovered and there is no antecedents to the discredit of the applicant. In view of that matter, the applicant is entitled to bail. Hence, the following order :-

ORDER
(i) The applications are allowed.
(ii) Applicant Naresh Suresh Kota be released on bail on furnishing P. B. and S.B. of Rs. 50,000/- with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions :- (a) He shall not tamper with the prosecution witnesses. (b) He shall not contact the victim or any witnesses till conclusion of the trial.
(c) He shall stay away from his Basmat District Hingoli for three months from the date of his release.
