It would be open for the petitioner to approach the State Government / Commissioner under section 48 of the Land Acquisition Act, 1894 or under section 101 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, since according to petitioner, actual possession has not been handed over to the State Government. If petitioner tenders application to the State Government / Commissioner within a period of eight weeks from today, the same shall be considered and appropriate order shall be passed within a period of six months from the date of receipt of such application. 2.
