DATE : 14/07/2017 PER COURT :- 1] The petitioner is the non-applicant no.2 in Revision Application No.481/2017.

2] That Application is pending before the Hon'ble Minister of Cooperation, Marketing and Textile, Government of Maharashtra. By his application the petitioner has objected to the Hon'ble Minister of Cooperation, Marketing and Textile Shri Subhash Deshmukh, to take up said Revision Application and prays that it be assigned to some other Minister or Secretary of the Department. 3] This application is made on 14/6/2017. The main Revision Application is also pending.

-24] Yesterday this matter was placed before us and we granted time to the learned AGP Shri Kale to take instructions. 5] After seeking instructions from all concerned including the Hon'ble Minister, Shri Kale informs the Court that the Minister will first take up the application filed by petitioner/non-applicangt no.2 dated 14/6/2017 seeking his recusal from the proceeding. The Department will issue an advance notice of the date and time of hearing on this application to the petitioner. AT that day and time, the petitioner or legal representative will be heard in person and the Minister will pass a reasoned order on this application and after which only he will proceed with the main matter. The Writ Petition is disposed of by keeping open all contentions. We clarify that we have expressed no opinion thereon.
