PER COURT :- 1) Heard. The petitioner is making grievance in respect of shifting his name from Ward No.2 to Ward No.3. According to the petitioner, his name has been illegally shifted without his knowledge and without extending an opportunity of hearing to him.
2) So far as right to contest the election is concerned, a voter, enlisted in one Ward can contest the election in any of the Wards. So far as right to franchise is concerned, the same is not taken away from the petitioner as his name already figures in the voters list prepared for Ward No.3. There is no prejudice caused to the petitioner on account of shifting of his name from one ward to another. Even otherwise, since the process of election has already been set in motion, no interference is called for in the instant petition. The petition is devoid of substance and the same stands rejected.
