Mr. Kharosekar, the learned counsel submits that the vehicle of the petitioner was seized under the panchanama dated 10.02.2020. Subsequently the report is submitted by the Tahsildar to the Sub Divisional Officer that the vehicle of the petitioner is not involved in illegal excavation and transport of the minor mineral. The said report is given on 25.08.2020, still the Sub Divisional Officer has not taken any action for releasing the vehicle.

The learned A.G.P. submits that the Sub Divisional Officer will take the necessary steps as per law.

It appears that the vehicle of the petitioner is seized for illegal excavation and transport of sand. The Tahsildar gave the report on 28.05.2020 about the non involvement of the petitioner's vehicle in the excavation and transportation of sand.

The Sub Divisional Officer, Ambad shall take decision on its own merits upon the report received by him (page 19), preferably within 15 days from today.

Writ petition is disposed of. No costs.
