Sachin Hanmantrao Chandolkar v. Committee For Scrutiny And Verification And ORS
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 912 REVIEW APPLICATION (CIVIL) NO. 170 OF 2009 IN WP/5516/2005 SACHIN HANMANTRAO CHANDOLKAR
VERSUS
COMMITTEE FOR SCRUTINY AND VERIFICATION & ORS ...
Mrs. MA Deshpande, AGP for Respondent/State.
...
CORAM : R. M. BORDE & P.R. BORA, JJ.
Dated: June 12, 2015 ...
PER COURT :- 1) Counsel for review applicant absent.
2) Perused the order dated 4th September, 2007 passed by this Court in Writ Petition No.5516/2005. The Tribe claim of the petitioner as belonging to "Mannerwarlu", Scheduled Tribe, has been turned down by the Caste Scrutiny Committee and the said decision of the Committee has been upheld by this court.
3) The matter was considered during earlier two rounds as regards the same grievance. It cannot be contended that the petitioner has not been extended full opportunity of hearing and that there is breach of observance of principles of natural justice. Even otherwise, the review applicant is not entitled to claim the benefit since it is noticed by us that there is manipulation in the original record relied upon by the review applicant during the course of inquiry. There is no error compelling us to exercise powers in review jurisdiction. 4) The Review Application is devoid of substance and the same stands rejected.
