Heard the learned Counsel for the respective parties. 2.

By way of present petition, the petitioners are assailing the order dated 16.03.2023 passed below Exhibit 58 by the Civil Judge Senior Division, Chalisgaon in Civil Misc. Application No.103 of 2019, wherein, the application filed by the petitioner for DNA test came to be rejected.

Learned Counsel for the petitioners seeks permission to withdraw the present petition with liberty to file appropriate proceeding before the Civil Court for raising the issue of paternity by fling a fresh suit.

In view thereof, the Writ Petition is disposed of as withdrawn, with liberty as prayed for.
