IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 6936 OF 2015 Mukesh Kumar Kaurav Rajesh Kumar Kaurav and others .. Petitioners
Versus
The Union of India and others .. Respondents Shri Pradeep Deshmukh, Advocate h/f Shri M. M. Bhokarikar, Advocate for Petitioners.
Shri S. B. Deshpande, A.S.G. for Respondent Nos. 1 to 8. CORAM : S. V. GANGAPURWALA AND K. L. WADANE, JJ.
DATE : 01ST SEPTEMBER, 2016.
PER COURT :
.
Mr. Deshpande, the learned A. S. G. raises preliminary objection that, the petitioners have remedy before the Central Administrative Tribunal. Earlier these persons approached Central Administrative Tribunal (for short "C.A.T.") and the C.A.T. directed the respondents to decide about their pay scale. Pursuant to the said directions the decision has been taken by respondents by a speaking order and the petitioners can assail the same before the C. A. T.
2 wp 6936.15 2.
Mr. Deshmukh, the learned counsel submits that, the question is about fixation of basic pay scale and the same be decided by this Court as the matter is pending for almost a year. 3.
Though, Mr. Deshmukh, the learned counsel for petitioners sought to canvass submissions on merits, we are not inclined to consider the same. The petitioners have an efficacious alternate remedy before the C. A. T.
4.
In the light of the above, we dispose of the writ petition with liberty to petitioners to approach the C. A. T. All contentions of respective parties are kept open. No costs. 5.
We request the Tribunal to decide the proceedings, if, filed by petitioners expeditiously and preferably within a period of one
(01) year from the date of filing considering the exigency in the matter.
