Jyoti Balaji Gedewad v. The State Of Maharashtra Through Its Secretary And Another
- 1 -
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.7797 OF 2022 JYOTI BALAJI GEDEWAD
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANOTHER Mr.P.V.Jadhavar, Advocate for the petitioner. Mr.P.S.Patil, AGP for the respondent/State.
( CORAM : RAVINDRA V. GHUGE AND ARUN R. PEDNEKER, JJ.) DATE : JULY 26, 2022 PER COURT :
1.
The petitioner has received a Scheduled Tribe Certificate as "Malhar Koli" instead of "Koli Malhar". It is well settled that an incorrect description of a tribe or a caste renders such a certificate invalid. The petitioner's father has approached the Authority by preferring an online application. However, the status of the application is indicated as "rejected". It is the petitioner, who is a 25 years old girl student, who desires a proper tribe certificate. 2.
As such, we permit the petitioner herself to make an application khs/July 2022/7797
- 2 - online for seeking a proper certificate as "Koli Malhar", to the Sub Divisional Officer. He shall verify the record of issuance of the certificate and shall issue a corrected certificate within a period of 6 weeks from the date of submitting the online application and on production of the original incorrect tribe certificate. 3.
In view of the above directions, this petition is disposed off. ( ARUN R. PEDNEKER, J. ) ( RAVINDRA V. GHUGE, J.) khs/July 2022/7797
