Mr. Thombre, the learned counsel for the petitioner submits that, the petitioner is physically handicap. The disability is 45%. The petitioner is seeking transfer from Central Primary School, Chikna, Tq. Dharmabad to the vacant post of Cluster Head at Kendra Loni (B) or Kendra Ardhapur in the Education Department of Panchayat Samiti Ardhapur or Zilla Parishad Primary Kanya School, Mudkhed. The petitioner has also made request to the respondent on 14.05.2018 (page 49), however, same is not considered.

We have heard Mr. Pulkundwar, the learned advocate for

2 wp 7148.18 respondent Nos. 4 to 6 and the learned Assistant Government Pleader.

The petitioner claims to be physically disabled person. The respondents may consider the policy dated 15th December, 2004 or such other policy as may be applicable and in vogue to the physically disabled persons seeking transfer. The decision on the same shall be taken at the time of general transfers effective for the academic year 2019-2020 on its own merits. The writ petition is disposed of. No costs.
