IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 941 WRIT PETITION NO. 8561 OF 2025 KAPIL RAMAYAA NALLEWAR

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER .....

Advocate for the Petitioner : Mr. Sunil Mahadevappa Vibhute AGP for Respondents/State : Ms. S.S. Joshi .....

CORAM : MANISH PITALE & Y.G. KHOBRAGADE, JJ.

DATE :

5th August, 2025 P.C. :- 1.

Heard learned counsel for the Petitioner. This is the second petition for the same cause has been filed. Earlier Writ Petition bearing No.2945/2025 was filed by this very Petitioner for identical relief for direction to the Respondent No.2/Scrutiny Committee to decide the tribe claim of the Petitioner at the earliest.

2.

The said Writ Petition was disposed of by the following order: "

The petitioner is anxious to have an early decision of the proceedings before the committee for validation of his tribe certificate and is seeking a mandamus to that effect. 2.

The writ petition is disposed of, with liberty to the petitioner to make an appropriate application to the committee, requesting for taking up the proposal out of turn by pointing out the exigency.

( 2 ) 941 wp 8561.25 The committee shall consider the petitioner's application to be filed on its own merits."

3.

We are informed that the Petitioner did approach the Respondent No.2/Scrutiny Committee in terms of the direction contained in the above quoted paragraph 2 of the order dated 03.03.2025 passed by this Court in Writ Petition No.2945/2025.

4.

The Petitioner is at liberty to pursue the Respondent No.2/Scrutiny Committee in terms of the liberty so granted. 5.

We see no reason to entertain this second petition for the same cause of action. We expect the Respondent No.2/Scrutiny Committee to consider the request of the Petitioner for expeditious disposal of the tribe claim.
