DATE : AUGUST 02, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0382 of 2019 registered with M.I.D.C. Police Station, Dis. Latur.

Heard learned counsel appearing for the parties. 3.

Perused the order dated 31.03.2022 in Bail Application Nos.399 of 2021 and 736 of 2021. Similarly placed co-accused have been granted bail in this crime.

Learned APP would submit that the applicant herein has also been arrested in connection with same another crime, which is punishable under Section of 302 of Indian Penal Code.

Perusal of paragraph 12 of the order dated 31.03.2022 referred to above, indicates that the applicant therein namely, Somnath, was also one of the accused in the said crime along with the applicant herein. As such, it is a clear case of parity. 6.

In view of the above, the Court is inclined to grant the applicant bail. Hence, the following order:- (i) The application is allowed.

(ii) The applicant be released in connection with Crime No.0382 of 2019 registered with M.I.D.C. Police Station, Dist. Latur, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) The applicant shall stay away from District Latur, except for attending the Court cases.

(iv) The applicant shall not tamper with the prosecution witnesses.
