In a scuffle between two families, the complainant would allege that Bhagwan and Shivaji Telang inflicted blows of iron rod on the head of Ashok and Yogesh and thereby caused serious injuries to them. The applicants herein allegedly abused the complainant, but no overt act has been attributed to them. On primary evaluation of the FIR conveys there is dispute between two families over loan/financial transaction. Co-accused Bhagwan and Shivaji were arrested and released on bail. Applicants have no criminal antecedents, except one which arose from a dispute amongst family members.

In my considered view custody of the applicants may not further the prosecution case. Therefore, the

In the event of arrest of the applicants in connection with Crime No.264 of 2021 registered with Sangamner Taluka Police Station, Dist. Ahmednagar, for the offences punishable under sections 307, 354(A)(1)(i), 326, 504, 506, 427, 34 of the Indian Penal Code, the applicants shall be released on bail on executing bond in the sum of Rs.20,000/- (Rupees Twenty Thousand) each with one or more sureties in the like amount. The applicants shall report to the Investigating Officer on 2nd, 4th, 6th, 9th, 11th, 13th August of 2021 between 11.00 a.m. to 01.00 p.m. and thereafter as and when called by the Investigating Officer.

The Anticipatory Bail Application is accordingly allowed and disposed of.
