According to learned counsel, this Court at Nagpur in case of similarly situated petitioners has granted relief and directed the Respondents to consider their case. Same recourse is required to be adopted in the present case also.

Mr.Kulkarni, learned counsel for Respondents submits that these petitioners had earlier filed Writ Petition before this Court, however, the same was rejected by this Court. The said judgment

will operate as res-judicata in case of petitioners. 4.

In view of rejection of earlier Writ Petition, the petitioners are estopped from again agitating the same issue. Even otherwise the petitioners have crossed the maximum age limit prescribed for being considered for appointment.

On both these counts, the Writ Petitions stand dismissed. No costs.
