THE STATE OF MAHARASHTRA AND OTHERS ...

CORAM :

SMT. VIBHA KANKANWADI & HITEN S. VENEGAVKAR, JJ.

DATE :

02nd DECEMBER, 2025 ORDER :

.

The petitioners by filing present petition pray for issuance of writ of Mandamus to direct respondent Nos.4 to 6 to forward a necessary proposal along with necessary information and documents to respondent Nos.2 and 3 for regularization of the services of the petitioners as labourers with respondent Nos.4 to 6. They are praying for issuance of appointment orders to them and then also the further prayer in respect of regularizing their services in view of the order passed by this Court in Writ Petition No.15221 of 2017 and Writ Petition No.7426 of 2019 dated 04.07.2019 as well as Government Resolution dated 10.01.2025.

930_WP_14371_2025 Learned Advocate for petitioners submits that names of petitioners are appearing in the list that was prepared. Then when no action was taken, they had filed the representation dated 24.01.2025 and 27.01.2025, however, that has not been decided. Learned AGP submits that perusal of order passed by Hon'ble Single Bench of this Court dated 04.07.2019 would show that the petitioners therein had approached the Industrial Court for regularizing the permanency and then after setting aside those decisions, directions were given by replacing the directions already given. So, the order that was passed was for petitioners in those proceedings. Here, the petitioners had not approached the Industrial Court and, therefore, they are required to approach the Court first and get their services regularize, if rules and facts permit. In view of the said statement learned Advocate for petitioners seeks withdrawal of the petition with liberty to approach the appropriate Industrial Court. In view of the said statement, we dispose of the writ petition with liberty as prayed.
