Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail as he is arrested in connection with Crime No. 36/2023 registered with Jamner Police Station, Jamner, District Jalgaon for the offences punishable under sections 302, 307, 506 of I.P.C. 3.
On perusal of the record, prima facie it appears that there is material available against the applicant to connect with the present crime. The wooden log used to commit the murder in this crime is having length of 29 inches. The circumference of wooden log at one side is 8 inches and at another side 17 inches. Considering the weapon used in this crime while committing the offence, I hold that prima facie prosecution has sufficient material against the applicant to prove the homicidal death and bail cannot be granted to the applicant in such a serious offence.

At this stage, the learned counsel for the applicant submits that if this court is not inclined to allow the application, considering that the applicant is arrested on 31.1.2023 and since then for last two and half years he is behind bars, liberty may be granted to the applicant to file fresh bail application if the
BA 1053/24 trial does not conclude within a period of one year from today. 5.
In view of the above, the application is dismissed. Liberty is granted to the applicant to file fresh bail application in the event the trial does not conclude within a period of one year from today. 6.
It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall not be influenced by the observations made hereinabove. 7.
The application stands disposed of.
