DATE : JULY 21, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicants have been arrested in connection with Crime No.0298 of 2022 registered at Nanded Rural Police Station, Dist. Nanded.

Heard learned counsel appearing for the parties. 3.
After having heard learned counsel for the applicants, learned APP and learned counsel for the informant, this Court expressed disinclination to grant bail to applicant nos.1 and 2 who
6-BA.990.2022 wielded iron rod. Learned counsel for the applicants, therefore, on instructions, came around to withdraw the application as regards applicant nos.1 and 2.

Applicant nos.3 and 4 are alleged to have wielded sticks. The head injury is attributed to the iron rod's blow. Admittedly, iron rod has not been wielded by applicant nos.3 and 4. Both these applicants are behind the bars for about 65 days. In view of the same, this Court is inclined to grant bail to these applicants, on condition that they shall not enter the village for six months 5.
Hence, the following order:- (i) The application stands disposed of as withdrawn as regards applicant nos.1 and 2 are concerned.
(ii) The application of applicant nos.3 and 4 stands allowed. Applicant no.3 - Bhanudas s/o. Motiram Puyed and applicant no.4 - Sanjay s/o. Govindrao Puyed be released in connection with Crime No.0298 of 2022 registered at Nanded Rural Police Station, Dist. Nanded, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) each with one surety each in the like amount.
6-BA.990.2022 (iii) These applicants shall not tamper with the prosecution evidence in any manner.
(iv) They shall not enter village Punegaon, Tq. and Dist. Nanded for next six months.
