The learned counsel appearing for the applicants, on instructions, seeks permission to withdraw the application with further liberty to take out appropriate application for discharge before the concerned Court.

In case, the applicant files the application for discharge within three weeks from today, the concerned Court to consider the said application and take decision on its own merits and in accordance with law, as expeditiously as possible, and preferably within six weeks from filing such application, in case the charge is not already framed.

We make it clear that in case, no such application is filed within three weeks from today, liberty granted today to the applicant will not be available to him.
