The learned Assistant Government Pleader submits that, appeal is maintainable against the impugned order. 2.

The learned advocate for the petitioner submits that, the petitioner has filed an appeal against the order rejecting the application of the petitioner by the Collector. The appeal was filed before the State Government, however, same is not yet decided.

It appears that, appeal has been filed by the petitioner only in the end of May 2019. Some time will have to be given to the

2 wp 7497.19 authorities to decide the appeal on its own merits. 4.

Considering the fact that, appeal is pending (Page 30), the appellate authority shall decide the same on its own merits, in accordance with law, expeditiously and preferably within a period of three (03) months from the date of appearance of the petitioner. The petitioner shall appear before the appellate authority on 16.07.2019.

In the light of the above, the writ petition is disposed of. No costs.
