IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 6747 OF 2015 SANTSHRI BABA MAHAHANASJI MAHARAJ
VERSUS
STATE ELECTION COMMISSION AND OTHERS ...
Advocate for Petitioner : Mr. Patil Vijay B.
Mr. ST Shelke, Advocate for Respondent No.1 & 2; Mr. SG Karlekar, AGP for Respondent No.3.
__________ CORAM :
R.M.BORDE & P.R.BORA,JJ.
DATE : 7 th JULY, 2015.
PER COURT :
1) Heard. The provisional voters list published by the State Election Authority for conduct of elections to the village Panchayat, is objected by the petitioner by raising an objection on 6th June, 2015. It does appear from the record that the objection was taken into consideration by the Tahsildar while recording his decision on 12.6.2015. The only objection that remains to be considered is as regards inclusion of names of dead persons in the electoral rolls. Proper care can be taken to
ensure that voting is not recorded in the name of a dead person.
2) Learned Counsel appearing for the State Election Commission, states that suitable instructions will be issued to the concerned Presiding Officer conducting the elections.
3) In view of the above, the grievances raised by the petitioner, in the instant petition, stand redressed. The writ petition stands disposed of.
